The Authority maintains a fair and transparent appeals process for travelers who believe their crossing denial was made in error. While the Department stands behind the professional judgment of our inspectors, we recognize that documentation issues and misunderstandings can sometimes be resolved through review.
Appeals Are a Privilege, Not a Right: The Authority provides appeals as a courtesy to ensure fairness. However, certain denial categories are not appealable, and frivolous appeals may result in additional restrictions. Use this process responsibly.

Standard Appeals Timeline
Phase 1: Appeal Submission (Day 1-7)
Traveler must submit written appeal within 7 days of denial:
- Complete Appeal Form AUT-2045-APPEAL
- Attach copy of crossing denial notice
- Provide detailed explanation of grounds for appeal
- Submit any corrected or additional documentation
- Pay appeal processing fee (150 credits, refundable if successful)
Submission methods: Online portal (preferred), mail, or in-person at regional Authority offices
Phase 2: Initial Review (Day 8-14)
Appeals Division confirms receipt and validates appealability:
- Verification that denial category is appealable
- Confirmation that all required materials submitted
- Assignment to Regional Review Officer
Appellant receives confirmation email/letter with case number and assigned reviewer.
Phase 3: Case Review (Day 15-28)
Regional Review Officer conducts thorough examination:
- Review of original denial documentation and inspector notes
- Examination of appellant's submission and evidence
- Verification of any corrected/updated documentation
- Consultation with original inspector (if needed)
- Independent assessment of denial validity
Phase 4: Decision (Day 29-30)
Review Officer renders final determination:
- Appeal Granted: Crossing authorization approved; appellant may proceed to checkpoint with approval letter
- Appeal Denied: Original denial upheld; written explanation provided
- Remand for Additional Review: Case sent to senior review officer for elevated consideration (adds 14 days)
Decision communicated via email and certified mail.
Processing Times May Vary
The 30-day standard timeline represents normal processing. Complex cases, high appeal volumes, or cases requiring additional investigation may extend timelines by 15-30 days. Urgent travel needs do not accelerate appeal processing—plan accordingly.

Your written statement is the most important component of your appeal. Effective appeals:

Appeal Decision Outcomes
Review Officers have three decision options:
Appeal Granted (Average: 47% of appealable denials)
The Review Officer determines that denial was in error or that corrected documentation resolves the issues. Appellant receives:
- Written approval letter authorizing checkpoint crossing
- Refund of 150-credit appeal fee
- Updated permit notation (if applicable)
- 60-day window to complete crossing
Granted appeals require presenting the approval letter at checkpoint along with all standard documentation.
Appeal Denied (Average: 49% of appealable denials)
The Review Officer upholds the original denial determination. Appellant receives:
- Written explanation of why appeal was denied
- Information about whether future crossing applications are possible
- Details on what must change for future approval
- Appeal fee is NOT refunded
Denied appeals may be eligible for Director-level review (see below).
Remand for Additional Review (Average: 4% of appealable denials)
The Review Officer determines the case requires elevated consideration. Case is forwarded to:
- Senior Review Officer (for complex documentation issues)
- Regional Director's office (for policy interpretation questions)
- Legal Division (for regulatory compliance questions)
Remanded cases typically add 14-21 days to processing timeline.
Director-Level Review (Second Appeal)
Travelers whose standard appeals are denied may request Director-level review under limited circumstances:
Eligibility for Director-Level Review
Second appeals are discretionary and granted only when:
- New evidence emerges that was unavailable during initial appeal
- Clear procedural errors occurred in initial appeal review
- Regulatory interpretation questions require Director-level policy guidance
- Exceptional circumstances warrant additional consideration
Director-level reviews are rare (approved for ~3% of denied appeals) and should not be expected. Most denials that survive initial appeal review will not be overturned at Director level.
Director-Level Appeal Requirements:
- Written request submitted within 14 days of initial appeal denial
- Detailed explanation of grounds for Director-level review
- New evidence or procedural error documentation
- Additional 300-credit processing fee (non-refundable)
Timeline: 45-60 days for Director-level decision

Scenario 1: Expired Permit by 3 Days
Situation: Traveler's permit expired 3 days before checkpoint arrival due to unexpected delays.
Appeal Strategy: Explain delay circumstances, demonstrate original permit was valid when journey began, submit renewed permit with appeal.
Likely Outcome: Granted (if explanation credible and renewed permit valid)
Scenario 2: Name Spelling Mismatch
Situation: Permit lists name as "John Smith" but ID shows "Jonathan Smith"—legally the same person.
Appeal Strategy: Provide birth certificate, legal name documentation, explanation that both names refer to same individual.
Likely Outcome: Granted (with notation for future reference)
Scenario 3: Biometric System Malfunction
Situation: Scanner failed to read fingerprints due to technical error, resulting in automatic denial.
Appeal Strategy: Request re-verification, note that identification documents are valid and unquestionable.
Likely Outcome: Remand for re-verification testing (usually granted after successful re-scan)
After Your Appeal Decision
If Appeal Granted:
- Present approval letter at any Authority checkpoint within 60 days
- Bring ALL required documentation (appeal approval supplements but does not replace standard requirements)
- Approval is valid for ONE crossing only
- Future crossings require new permits following standard application process
If Appeal Denied:
- Carefully review denial explanation to understand what must change
- Correct identified deficiencies before reapplying for travel authorization
- Consider Director-level review only if you meet eligibility criteria
- Future applications possible once issues are resolved
